WAKEFIELD, Mass. (WHDH) -- Gov. Deval Patrick is calling for stricter regulations for level 1 sex offenders following the arrest of a Wakefield man who allegedly sexually abused 13 children.

State investigators starting looking into complaints about the unlicensed day care center three years ago, but they couldn’t find any evidence until a few months ago.

John Burbine remains locked up on child rape and abuse charges, while his wife, Marian Burbine is under house arrest. She's accused of running an unlicensed child care center and allowing her Husband to babysit children even though police said she knew he was a level 1 sex offender.

The commissioner of the State Department of Early Education and Care said it first went to the Burbine's Wakefield home in 2009 after getting a complaint about an unlicensed day care center. Killins said her investigators talked to Marian Burbine and made four unannounced visits to the home. But, the case was closed when no evidence was found.

“Our agency did not drop the ball at all,” said Sherri Killins, Mass. Early Education and Care Commissioner.

There was another complaint last July about the Waterfall Education Center in Wakefield which police said was run by Marion Burbine. After talking to neighbors and examining the Center's website, the state issued a cease and desist order.

“There was a website that had misleading information. We have received a copy of an e-mail that seems she was offering summer camp care, which all are inappropriate because she was not a licensed provider,” said Killins.

A mother who says her child was tutored, but not abused by John Burbine, told 7News she was stunned to hear he was a level 1 sex offender.

“When we did our due diligence and Googled and looked at the sex offender list before we even considered this tutoring company, he did not pop up,” she said.

Gov. Patrick said Friday he's pushing legislation that would make information about level 1 sex offenders easily available to the public, such as information about level 2 and 3 offenders.

“Well, look I think any law that would help deal with a situation as horrific as this one would be helpful,” said Gov. Patrick.

After Marian Burbin was arrested and put under house arrest, she was ordered to stay away from kids. The state also sent her lawyer a letter saying her teacher certificate would be revoked for a minimum of five years.
